<h2>What is the MCS-150?</h2>
<p>The “Motor Carrier Identification Report”, better known as the MCS-150 requests a U.S. DOT number for carriers. This form is filed initially when first requesting a U.S. DOT number.</p>
<p>Based on information provided in the MCS-150 is vital to the placement of your business in the proper grouping for Compliance, Safety Accountability (CSA) scoring purposes. (See <a title="About CSA 2010 – What Is It?" href="http://www.officetenders.com/about-csa-2010-what-is-it/">About CSA 2010- What is it?</a>)</p>
<p>You are strongly advised to keep your MCS-150 information current by updating it whenever your business changes anything pertaining to the MCS-150. Errors in this form, or failure to keep it updated could result in the wrong designation for your company. This could result in incorrect CSA ratings.</p>
<h2>Review Your MCS-150</h2>
<p>A MCS-150, and instructions, can be found at fmsca.dot.gov under “Registration &amp; Licensing”. If you currently have a MCS-150 on file, you can find it on-line by going to the <a href="http://www.fmcsa.dot.gov/">FMCSA website</a>. Select “Find A Company’s Status” using your USDOT number and business name or your operating authority number.</p>
<p>Then select “Company Snapshot” under FMCSA Searches about half-way down the page.</p>

<p>Being a new trucking business means that you will be the subject of a “Safety Audit” sometime within the first 18 months of being in business. The audit is likely to be after about three months. Companies are given enough time to record some operating history so that your safety management controls are established.</p>
<p>Audits help carriers identify safety risks. You will be given a 60-day corrective action period. During that time, you will need to correct all deficiencies found during the audit. Passenger transportation and hazardous materials that require placarding are given 45 days to correct deficiencies.</p>
<p>A “Safety Audit” is based on elements critical to basic safety management involving operation in interstate (across state lines) commerce. Motor carriers fail the audit if regulation compliance is found to be lacking.</p>
<p>If this happens, your US DOT registration is revoked until the DOT is satisfied with your corrective actions.</p>
<h2> SAFETY ELEMENTS</h2>
<p>Overall the various elements (there are 16) that are reviewed during an audit include:</p>
<ul>
<li>Drug and Alcohol Program</li>
<li>Financial Responsibility (Insurance)</li>
<li>Driver and Commercial Driver License (CDL) Requirements</li>
<li>Driver records of duty status (Hours of Service compliance)</li>
<li>Motor Vehicle out-of-service status</li>
<li>CMV periodic inspections</li>
</ul>

<p><span style="color: #000000;"><strong>1. 2009 Company Reviews:</strong></span><br />
a. 67% of the reviews had acute violations of the Drug &amp; Alcohol program.<br />
b. 90% of the 67% either had no program or failed to randomly test their employees.<br />
c. 7,430 enforcement actions were taken and 49% of those actions included Drug &amp; Alcohol violations of which $11 million in penalties were  leveled.</p>
<p><span style="color: #000000;"><strong>2. An employee should not be hired until a negative drug result is received. </strong></span><strong>It is a violation and will continue to be<span style="color: #000000;">.</span></strong></p>
<p>What can Office Tenders do to help?</p>
<p>A COMPANY is fully in charge of their hiring practices.  We can only sign a new driver up with drug &amp; alcohol testing and/or Driver Qualification Files when contacted by the company.</p>
<p>Companies must make “Pre-employment Drug testing” part of the application process…not something to do after the employee is hired.</p>
<p><span style="color: #000000;"><strong>3. There is still a lack of good faith effort to check to past history of new employees or not having it done at all.  Documentation of more than 1  attempt to retrieve the information from previous employers for the 3 years period must be kept on file.</strong></span></p>
<p><span style="color: #000000;"><strong>WHAT DOES OFFICE TENDERS DO TO AID COMPLIANCE</strong></span></p>
<p>When a client elects to have Office Tenders do DRIVER QUALIFICATION FILES, we complete the appropriate forms for the employee to sign. The employer must mail the completed forms to previous employers for the past 3 years.</p>
<p>We also provide a checklist that remains with the employer. That checklist, if used properly, is to remind the employer to follow-up if no response is received within 2 weeks of the previous employer receiving the inquiry. Room is provided for documenting the responses received.</p>

			<content:encoded><![CDATA[<p><strong>Recently a survey conducted LexisNexis states that as many as half of the driver qualification files motor carriers keep  are incomplete or inaccurate.</strong></p>
<blockquote><p>&#8220;Those driver files, required by the Department of Transportation,  either lack necessary documents or have records that were completed  incorrectly, the company said in its first annual Commercial Driver  Safety Report, released Monday.</p></blockquote>
<blockquote><p>&#8220;It could be something as simple as missing a signature, or it could  be something substantial, like a revoked drivers license,&#8221; said Hayley  Hitchcock, director of vertical strategy at LexisNexis Risk Solutions.&#8221;</p></blockquote>
<p>Driver qualification files will become even more important to  carriers under the DOT&#8217;s Comprehensive Safety Analysis 2010 initiative,  Hitchcock was quoted saying&#8230;</p>
<blockquote><p>&#8220;Where DQFs really come into play is in an audit,&#8221; said Hitchcock.</p>
<p>&#8220;We recommend the industry go through the process of completing an  internal risk assessment, especially if they are a very paper-based  organization.&#8221;</p></blockquote>

<p>A review of Part 391 will help you quickly determine if you are ready for a <strong>Department of Transportation</strong> (DOT) audit.  The following items are required to be in the DQF:</p>
<ul>
<li>Application for employment</li>
<li>Previous 3 years employer inquiries &amp; responses</li>
<li>Initial state motor vehicle record (MVR)</li>
<li>Annual MVR</li>
<li>Copy of current Commercial Driver License (CDL)</li>
<li>Road test (if required for type of vehicle to be driven) or acceptable equivalent</li>
<li>Initial supervisor review of driving record</li>
